5. SMS / Text Messaging
5.1 How We Use Your Phone Number
If you submit a phone number through one of our forms (including the AI Creative Strategist form), you are providing express written consent for Eleviam to send you SMS messages related to the audit or service you requested, plus occasional follow-up messages from Eleviam. Phone numbers are used for transactional confirmations, audit delivery notifications, and limited follow-up communications. Message frequency varies based on the service you requested, typically no more than four messages per month following an initial submission.
5.2 Message and Data Rates
Standard message and data rates may apply based on your mobile carrier and plan. Eleviam does not charge a separate fee for SMS messages.
5.3 Opting Out
You can opt out of SMS messages at any time by replying STOP, UNSUBSCRIBE, END, QUIT, or CANCEL to any message you receive from us. You will receive a single confirmation message and no further messages from us. Reply HELP at any time for assistance, or contact us at tom@eleviam.io.
5.4 Mobile Information Sharing
No mobile information collected through our SMS opt-in process will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing in connection with SMS is limited to subprocessors that help us deliver messages (such as our SMS service provider) and is governed by their own privacy practices and confidentiality agreements with us.
5.5 Carrier Disclosure
Mobile carriers are not liable for delayed or undelivered messages. SMS service is provided on an as-is basis subject to carrier availability and routing.
6. Email Marketing and Commercial Communications
6.1 Transactional and Follow-Up Email
If you submit your email through one of our forms or otherwise opt in to receive communications from Eleviam, you consent to receive transactional emails (such as audit confirmations, scheduled delivery notifications, and account-related messages) and limited marketing or follow-up emails from us. Every commercial email we send includes a clear unsubscribe link that, when clicked, removes you from future marketing communications within ten business days as required by the CAN-SPAM Act of 2003. You may also unsubscribe at any time by emailing tom@eleviam.io. Transactional emails directly tied to a service you requested may continue until that service is delivered, regardless of unsubscribe status.
6.2 The Eleviam Newsletter
Separately from the emails described above, Eleviam publishes a weekly newsletter covering Amazon and TikTok Shop growth. Our application and lead magnet forms include a checkbox offering the newsletter. For most visitors that checkbox is selected by default and can be cleared before you submit. If your browser's time zone is in Europe, it starts cleared, and you are only subscribed if you select it yourself. If the checkbox is selected when you complete the submission, your email address and first name are added to our newsletter list. If it is cleared, they are not. Forms that you start but do not complete are never added to the newsletter list. An application that ends because your brand does not yet meet our revenue requirements counts as completed.
Some places on this site offer only the newsletter: the signup boxes on our homepage, blog and resources pages, and a small window we may show when you are about to leave a page. These carry no checkbox, because nothing else is offered there: the heading, the description and the button all say newsletter, so submitting your email is the subscription. If you do not submit, nothing is collected and nothing is sent.
You can leave the newsletter at any time using the unsubscribe link in the footer of any issue, or by emailing tom@eleviam.io. Once you unsubscribe, submitting another form on this site will not resubscribe you; your unsubscribe is treated as permanent unless you ask us to reverse it.
6.3 Email Service Provider
Our newsletter is delivered by Brevo (Sendinblue SAS), a service provider based in France. When you subscribe, your email address, first name, and the name of the form you submitted are stored in Brevo on our behalf, and are used only to send you the newsletter and to measure whether it was delivered and opened. Brevo processes this data under a data processing agreement with us and does not use it for its own marketing.
7. Legal Bases for Processing (EEA/UK Users)
If you are located in the European Economic Area (EEA) or United Kingdom (UK), we process your personal data based on the following legal grounds: your consent, where you have given clear consent for us to process your personal data for specific purposes (such as marketing communications and non-essential cookies); contract performance, where processing is necessary to fulfill our contractual obligations to you; legitimate interests, where processing is necessary for our legitimate business interests (such as improving our services, fraud prevention, and direct marketing to existing customers), provided these interests are not overridden by your rights; and legal obligations, where processing is necessary to comply with applicable laws and regulations.

We may share your information in the following circumstances: with service providers who assist in operating our business, such as payment processors, hosting providers, email services (including Brevo, which delivers our newsletter as described in Section 6.3), and analytics providers, under confidentiality agreements; with advertising partners, including Google, LinkedIn, and Meta, as described in Section 3, to deliver and measure advertising campaigns; when required by law, legal process, court order, or regulatory authority; to protect our legal rights, property, or safety, or that of our users or others; in connection with a merger, acquisition, or sale of assets, in which case you will be notified of any changes to this Privacy Policy; and with your consent or at your direction.
9. International Data Transfers
Your information may be transferred to and processed in countries other than your country of residence, including the United States. While we strive to protect your information, we cannot guarantee absolute security, and you acknowledge this inherent risk when sharing information online.
